I may be wrong, but I believe the only thing Forest can do is insist that we pay the £60m in one go upfront. That is what I would do if I were them.
 
The funny thing is that this window £60m is actually a reasonable fee when you consider the price tag put on wingers and attacking midfielders of similar ability. We could simply say we looked at the market and offered what we felt was a good price. I would like to see them prove anything to the contrary.

He always talks nonsense. If Talk Sport have invited him on to talk transfers then they want him to come out with things that hasn't been said before to add value, ie this sort of gonads. The quality of Talk Sport as a source of inside info is poor.

Nothing to see here....
How is Alex crook known and qualified as chief football correspondent? He just picks up the paper and says “ his sources can reveal” etc ….
 
This is very simple and i'm unsure why people have difficulties understanding it: we've either triggered his release clause or we haven't:
- If we haven't and Forest are able to negotiate the fee, then they don't have a "tapping up"/"breach of confidentiality" complaint.
- If we have, then there won't be any further negotiation on the fee as he has been released from his contract and is free to discuss signing terms with us if he wants.

I think this is actually where the dispute comes in- we haven't asked permission from Forest to speak to him and book the medical etc as we have made an offer triggering the release clause and therefore actually he is no longer technically a Forest player from the moment that offer is formalised (assuming the press reports re: the release clause are accurate). I'm assuming that was what our own internal legal advice was re: the transfer.

Forest are probably seeking their own internal legal advice on where they stand in respect of the situation. If the release clause has been triggered, there isnt actually anything they can do.
 
Indeed it's a very good point about the payment terms.
If a club puts a £60m release clause on a player, they expect the money in 1 lump sum, they would not accept nor expect 60 payments of £1m nor 20 payments of £3m nor 3 payments of £20m and why should they.

So we would have to stump up the whole £60m in one go, or do something like 3 payments of £22m to get it done.

I wonder if the release clause was something odd like £60,123,423 so they know we had insider info.

The idea of a 'secret' release clause is strange but plausible i.e. Forest would hope they can reject our offers of 45 and 55 and there is nothing the player can say or do... then we might bid 63 and they say "a-ha, now you have hit the magic figure and you can talk to MGW/CAA" but of course, at that point it gets a bit silly because we would find out the lower release clause and thus reduce our offer? All moot anyway. Not mute, moot.
 
The deal will go through for legal reasons.

Even the most optimistic employment lawyer would see that his contract clearly stated that they was a release caveat of sixty million pounds.

Ignorance by the club regarding that clause in his contract is no excuse irrespective of the amount of the release clause.

The fact that no one reviewed the players contract (or all players contracts which i bet is happening at Forest now) is down to the clubs secretary who must have signed off on the contract when the player, and agent signed the contract.

The waffle about what the player is worth is irrelevant, the crux of the matter is what is written on the contract, legal and agreed by all parties, which is was.

Forest and their fat taco of an owner will now possibly ask for the money up front, and this then will be down to Levy who i think somehow will overcome this.

Bottom line is the secretary at Forest witnessed and agreed to the terms in the contract at the time, and when the player developed beyond their wildest dreams did nothing to change the contract.

Their incompetence is galling and no doubt someone will get for for that.
